(Hereinafter referred as the Contracting Authority)

For the sake of keeping transparency, equal treatment and non-discrimination principles while selecting suitable service providers and applicants for contract allocation, the company has decided to publish on its websites: http://www.airport-k-vary.cz also the information about selection procedures for tenders over CZK 250,000 without VAT commissioned outside the force of the provision of law No. 137/2006 Sb. about the public contracts, as amended, so the procedure principles according to the §6 of the above-cited law will be kept.

This kind of tendering and selection and further execution of the orders should serve for selecting suitable applicants through the official procedures for the price usual in the place of execution. It should be neither considered as the public tender according to the §847 et sec as per Act No. 40/1991 Sb., of the Civil Code as amended, nor the public tender competition according to the §281 et sec as per Act No. 513/1991 Sb.,of the Commercial Code as amended.

I. General conditions of participation in the tender for orders:

1. Submission of the applicant’s bid for the selection procedure to the Contracting Authority address by the appointed date and meeting the basic and suplementary qualification measures as defined by the Contracting Authority are the esential conditions for participation in the selection procedure.
2. The Contracting Authority reserves these rights:
   1. the right to cancel a particular selection procedure at any time,
   2. the right not to sign the contract with any applicant or another person,
   3. the right to negotiate the contract conditions with the applicants, whose bids will be evaluated,
   4. the right to exclude the applicant who has or had payment discipline issues with the Contracting Authority,
   5. the right not to select any applicant,
   6. the right to change the contract letting for the tender of the selection procedures.
3. The execution of orders is carried out for a consideration on the basis of the written contracts made with the selected applicants.
4. The offer (draft agreement) signed by the successful bidder is accepted by concluding the contract, e.g. delivering the contract, signed by the authorized representatives of both contracting parties, to the selected applicant. Other legal acts of other Contracting Authority’s persons do not have the character of accepting the offer (draft agreement) and do not obligate the Contracting Authority to any performance.
5. Unless otherwise specified in the contractual documents, the applicants have no right for the expenses compensation related to their bids processing and delivering to the Contracting Authority. The Contracting Authority keeps the received bids as a proof of the course of the selection procedures.

II. General requirements for the qualification of applicants:

1. The applicants have to document their qualification, which consists in documenting basic and subsequent qualification criteria, which may be specified individually for each order in scope and form of submission.
2. Should the applicant’s documents confirming the basic and subsequent qualification criteria contain false information or false statements, such applicant will be immediatelly excluded from the selection procedure.
3. The Contracting Authority is entitled, besides asking for references or other documents about the execution of the order of similar character, to condition the contract letting by direct presentation or demonstration of the subject matter at another user's.
